General Terms and Conditions (GTC) ONYX Chauffeur Service

1. Scope of application & defense clause

All business relationships between ONYX Chauffeur Service, owner Raci Bilgin (hereinafter referred to as "ONYX" or "Provider") and the customer (hereinafter referred to as "Customer" or "Passenger") are governed exclusively by these General Terms and Conditions in their current version, which can be viewed on the website, in the vehicles, and at the business premises of ONYX.
Any deviating terms and conditions of the customer shall not apply unless ONYX has expressly agreed to their validity in writing.
By using the website www.onyx-chauffeurservice.de, booking or using a service, the customer accepts these GTC.
ONYX reserves the right to change or update the GTC at any time with future effect. The current, published version is authoritative.
When traveling abroad, passengers are required to carry valid identification documents, visas, or other necessary documentation.


2. Subject matter of the contract & conclusion of the contract

ONYX provides professional passenger transport services, in particular:
chauffeur service, airport transfers, trade fair and event trips, day trips and long-distance trips, sightseeing and excursion trips, as well as vehicle provision with driver on an hourly basis.
The contract is concluded upon confirmation of the booking by ONYX – in writing, electronically (e.g., by email, WhatsApp, or booking form) or via the website.
All offers are subject to change. A booking confirmation constitutes the binding conclusion of the contract.
ONYX is entitled to make adjustments to services if these are necessary, reasonable, and equivalent in content.
Transportation is provided in accordance with the applicable provisions of the German Road Traffic Regulations (StVO) and the German Passenger Transportation Act (PBefG). Passengers must follow the driver's instructions.
In the event of violations that endanger safety or order, the driver may exclude passengers from transportation. In this case, the full fare remains payable.


3. Booking, use, and procedure

Bookings can be made by telephone, email, partner platforms, or via the website.
The customer will receive a booking confirmation containing all essential details: pick-up time, location, vehicle category, price, and driver information.
Upon receipt of the booking confirmation, the customer is obliged to check the details and report any discrepancies immediately.


4. Prices

The price agreed upon at the time of booking applies.
All prices are in euros (€) and include statutory value added tax, unless otherwise stated.
The price generally includes all standard additional costs (e.g., parking fees, tolls). Additional costs (e.g., waiting times, additional stops, route changes) will be charged separately in accordance with the valid price list.
In the event of late payment, ONYX reserves the right to charge the statutory default interest rate and a flat-rate reminder fee of €10.00.


5. Terms of payment

Payment can be made as follows:
Credit card (Visa, Mastercard, Amex) – in the vehicle or in advance online
PayPal / SumUp link / online payment – after invoicing or before the journey
Cash payment – only by prior arrangement
Prepayment (bank transfer) – possible for company and partner bookings
The invoice amount is due on the day of the journey at the latest, unless otherwise agreed in writing.


6. Cancellations & Withdrawal

Cancellations must be made in writing (email or WhatsApp) and are only valid once confirmed by ONYX.
Cancellation policy:
Up to 24 hours before departure: free of charge
Less than 24 hours or no-show: 100% of the agreed price
The following applies to airport pickups: If the passenger does not show up despite the waiting time (60 minutes after landing) and no contact can be established, the service is considered to have been provided.
The customer is entitled to prove that ONYX has incurred no or less damage.


7. Waiting times

Standard pickup (hotel, address, etc.): 15 minutes free of charge
Airport pickup: 60 minutes free of charge from actual landing time
After that, the waiting time will be charged at €15 per 15 minutes.
Flight delays are automatically taken into account, provided ONYX has the correct flight number.


8. Customer obligations and conduct

Passengers must behave in accordance with traffic regulations during the journey and wear seat belts.
The customer is liable for any damage to the vehicle or inventory caused by them or their fellow passengers.
The driver is entitled to refuse or terminate the journey if the passenger is visibly intoxicated, aggressive, or dangerous. In such cases, there is no entitlement to a refund.


9. Baggage

Normal luggage is included in the fare.
Dangerous, explosive, highly flammable, or foul-smelling substances are not permitted for transport.
ONYX is not liable for damage to or loss of luggage unless caused by intent or gross negligence.


10. Liability

ONYX shall only be liable for damages resulting from intent or gross negligence.
In cases of simple negligence, ONYX shall only be liable for breaches of essential contractual obligations, but limited to typically foreseeable damages.
Liability for personal injury remains unaffected.
ONYX accepts no liability for third-party services arranged on its behalf (e.g., hotels, tickets, third-party shuttles).


11. Data protection

ONYX collects, stores, and processes personal data exclusively within the framework of legal provisions (GDPR, BDSG).
Customer data is used only for contract processing and is not passed on to third parties, unless there is a legal obligation to do so or the customer expressly consents.

12. Copyright & Website Use

All content, text, photos, and logos on the website are the property of ONYX Chauffeur Service.
Reproduction or commercial use is prohibited without written consent.


13. Place of jurisdiction & applicable law

The law of the Federal Republic of Germany applies.
The place of jurisdiction for disputes with entrepreneurs or legal entities is Munich.
For consumers, the statutory place of jurisdiction applies.

14. Severability clause

Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
The invalid clause shall be replaced by a provision that comes closest to the economic purpose of the original clause.
